As pointed out by @bread in #bot-commands, the error code we are serving for account bans is the incorrect one.

Previously, we were serving BANNED_DEVICE_IN_NEX_SERVICE. This is incorrect. On Nintendo Network, BANNED_ACCOUNT_ALL is used.
